Confirmation of Ultimate Beneficial Owners鈥� Information in the Register of Ultimate Beneficial Owners System

The Department of Registrar of Companies and Intellectual Property (DRCIP) informs that all companies incorporated or registered under the Companies Law, Cap. 113, all European Public Limited Liability Companies (SE), and all Partnerships (hereinafter referred to as "Organisations") or their respective officers/partners are required to log into the Register of Ultimate Beneficial Owners (UBO Register) system from 1 October 2024 to 31 December 2024, to confirm the information of their ultimate beneficial owners (UBOs), or their senior management, or perform due diligence (as applicable in each case).

Please note that if by 31 December 2024, you have not confirmed the information as required in the UBO Register, regardless of any criminal liability or prosecution of any individual, the organisation and each of its officers/partners will be subject to a financial penalty of two hundred euros (鈧�200) on the first day and an additional one hundred euros (鈧�100) for each day the violation continues, with a maximum total penalty of twenty thousand euros (鈧�20,000).

Urban Planning Amnesty: What the new Plan entails

The new Plan aims to allow citizens to legalise unauthorised constructions in approved developments, specifically for minor regulatory deviations that do not significantly affect the overall development, type of construction, or the living conditions of nearby residents.

The proposed will only apply to unauthorised constructions in buildings that obtained a planning permit and/or a building permit up to the date of the current Ministerial Council decision. The goal is to secure Approval Certificates and issue Property Titles. The plan will be in effect for six months from the approval date, allowing citizens to submit applications promptly before the deadline, while also limiting the possibility of further unauthorised constructions.

The new Plan is being promoted because the previous one, implemented on 29/07/2015 and in effect for four years until 31/12/2019 (later extended until 31/12/2023), legalised only 3,151 planning applications, a number far smaller than the actual number of unauthorised constructions.

The plan covers a broad range of applications, including residential, industrial, office, and recreational/entertainment developments.

It also applies to buildings that obtained planning or building permits by the date of the Ministerial Council decision, allowing a significant increase in eligible participants.

The plan introduces compensation fees for residential developments that exceed building density regulations. These are categorised into three levels: within the main structure of the existing building, extensions (either horizontal or vertical) outside the main structure, or in cases where an additional residential unit has been created due to unauthorised construction. Compensation fees will also apply to other types of developments that exceed building density regulations.

Additionally, compensation fees will be required for regulatory deviations such as covered verandas/pergolas, reduced distance from boundaries, increased coverage percentage, or increased height or length of auxiliary buildings along shared borders. These deviations will be classified as minor or more significant.

Compensation fees will be allocated to the Special Funds of the Cyprus Land Development Corporation for the Affordable Housing Plan, at a critical phase before issuing planning permits. Ten percent of the required compensation fee will be deposited into the Local Authorities' accounts to cover the administrative burden from the plan's implementation.

It is noted that the market value of the building density will be calculated based on the current General Valuation Tables from the Department of Lands and Surveys, with the completion of a Special Form for the Purchase of Building Density Exceedances. For regulatory deviations from Development Plan provisions, a specific amount will be set for each category based on the scale and significance of the deviation and the administrative area (Local Plan/Area Plan or Policy Declaration for Rural Areas), using the Compensation Table.

The Plan also applies to residential apartments in existing multi-unit buildings for legalising constructions that involve incorporating covered verandas or enclosing open verandas into the residential unit, provided that all co-owners consent in writing.

In cases of building density exceedances in residential developments, compensation fees will be calculated based on market value (General Valuation from the Department of Lands and Surveys) and will be differentiated as follows:

  • A compensation fee of 20% of the value of the building density exceedance for applications involving an increase in the buildable area within the structure of the originally approved building.
  • A compensation fee of 25% for an increase in buildable area through vertical or horizontal extensions outside the main structure.
  • A compensation fee of 30% for an increase in buildable area due to an unauthorised additional residential unit.

In the case of a shop that secured a planning permit and/or building permit before the date of the current Ministerial Council decision, where a mezzanine was converted into primary use without obtaining the required planning permit, the Planning Authority may approve this conversion to assist small businesses in increasing their usable space and improving their operations. This applies to ground-floor shops with a floor area of up to 80 square meters, or to ground-floor shops used as offices. Approval can be granted regardless of the ceiling height (even if it is below 2.60 meters), and this area will not be counted toward the building density, nor will additional parking spaces be required. This incentive can also be applied in cases of consolidating shops into a single business, even if the combined floor area exceeds 80 square meters.

Under the Plan, the Planning Authority has the flexibility to go beyond its usual limits. Specifically, the following provisions are included:

  • The Urban Planning Amnesty Plan allows the Planning Authority to evaluate and approve unauthorised extensions based on their merit, regardless of any regulatory provisions (Development Plans, Orders, etc.), and without the need for approval from the relevant Local Authority. This applies to buildings with an initial planning permit and/or building permit issued before the date of the Ministerial Council decision. These unauthorised extensions fall into two categories: minor technical deviations and more significant deviations.

  • Technical deviations include building distances from plot boundaries, distances between primary and auxiliary buildings, exceeding the coverage percentage, the length of contact between auxiliary buildings along shared borders, the maximum allowable height, and the number of floors in both primary and auxiliary buildings. The Planning Authority exercises discretion in these matters. It is understood that unauthorised extensions should not alter the building's architecture or affect the comfort of neighbors, the environment, or the character of the area.

  • The amount of compensation will vary depending on the scale and significance of the deviation, as well as the area in which the property is located (Local Plan/Area Plan or Rural Policy Declaration), based on the Compensation Table.

Turnover Value Index of Wholesale Trade  and of trade/repair of motor vehicles: 2nd quarter 2024

The Turnover Value Index of Wholesale Trade (Division 46) during the second quarter of 2024 recorded an increase of 7,7% compared to the corresponding quarter of the previous year. For the same quarter, the Turnover Value Index of Sales and Repair of Motor Vehicles (Division 45) recorded an increase of 11,8% compared to the corresponding quarter of the previous year.
